I got an email from some douche that wants to sue netflix. My problem is that it says i'm already a part of this lawsuit just for being a netflix member. They say i have to send a letter (you know, the kind that costs money to send) to exclude myself. If i don't "my rights will be effected". Now i'm pretty damn sure that my rights are mine and no one can do something on my behalf that would compromise my rights with out me signing something that would give them power over my rights. If what these fuck wads are doing is legit then that would mean i could strip any one of there rights by sending them an email.

This is pretty much the same damn thing as the email i got. It would seem that you can take away a persons rights by sending them an emailed opportunity to save their rights. If not then what they are doing to me is grossly illegal, and i would like tto know who it is so i can do some suing of my own. But the web site and phone number (no humans available) didn't ever tell me whos' in charge. Some douche bag is out there sending me emails and i want to know who. Also i like netflix. How could we remain friends if they see my name come up as some one that sued them? Oh yeah what they are sueing over is that netflix was sharing info about what people like to watch. THAT'S WHAT I EXPECT THEM TO DO! I wouldn't bother rating things if i didn't think netflix was letting people know how people like the shit they watch.

Firstly I'm not a lawyer, basing this entirely on experience/what I've read/seen on TV etc.
As far as I know most class action lawsuits automatically include all the people in the class in question, and every person has to opt-out on their own. So, they sadly are on their legal right in including you in the lawsuit by default. I would think contacting somebody there via email to inform them that you wish to opt out of the lawsuit, to be sufficient. But if as you've said it's impossible to get a response from a human, I would follow the opt-out instructions you received, and include a message saying that their contact options suck, and you wish to be reimbursed for having to send a physical letter to opt-out (guessing on this, no idea if they're required to or not, but even if they aren't, it would still make sense for them to be nice and do it, their fault after all)

Your Options
If you do nothing, you will remain in the Settlement and your rights will be affected. If you do not want to be included, you must exclude yourself by November 14, 2012. If you exclude yourself you will keep your right to sue Netflix about the claims in this lawsuit. If you remain in the Settlement, you can object to it by November 14, 2012.

fun fact: i just called netflix and asked them what information the keep (i didn't remember what i gave them any how) and it's name (which could be fake) and email (which proves nothing of identity cuz you can fake that sign up) Billing details of coarse. shipping if you get mail dvds (i don't, and i actually pay some one else for there card use) But my point is, they don't have my social security number they only ask for the last 4 card numbers. They don't have my address or phone number. What the fuck information should i care about them sharing with people?
