Re: Permajail for...what?
Day 5 of my captivity:
Do I have any rights? A right to a trial? Gnatogryz said something about proof beyond a reasonable doubt. He also admitted you had not proved I violated the rules. Have you made your decision? Have I been convicted or do I have a right to trial (preferably by jury).
Yukar appears to be Judge and Executioner. Gnatorgryz appears to be the State Prosecutor.
Do I have a right to counsel?
I have some statements I think I should make on my own behalf, if the State is done presenting the evidence it claims to have against me. However I'm afraid such statements might be used against me if I have not yet been convicted.
If I've been convicted, then before I am sentenced I would like to consult with a senior member (not necessarily admin, but someone who knows simpvp server culture and may have some insight into the mechanism by which I am to be [or perhaps already have been] tried, convicted, and punished if found guilty).
I have certain information of a germane nature to this inquiry but I am unsure if it would be better for my case if I left it unsaid.
I will, however, note for the record that the Rules as I understand them, as published, witnessed by myself, and agreed to by me (implicitly by simply logging on to your server) are as follows:
"Our three rules are:
1. Griefing, killing and stealing is allowed.
2. Hacking, flying, spamming, glitching, x-ray, or anything that confers an unfair advantage,
is strictly forbidden.
3. Asking admins for free stuff/day/night/teleport, is forbidden, punished by being called a noob." http://simplicitypvp.net/?p=rules
Could an Admin please confirm that I am being charged with violation of Rule #2 for allegedly using an x-ray hack to locate diamonds. Are those the rules and charges as I understand them?
Have I been convicted yet? Shouldn't there be a vote?
Just 'cause it's anarchy doesn't mean there shouldn't be due process. I demand a jury of my peers and I humbly request the counsel of a senior non-admin member.
Also, is life in prison the punishment for the crime I accused of? Your prison is essentially a cesspool of spawn-noobs and hot lava... the indignities and insults I've suffered ... and the horrible things they've done to me... please for the love of God don't let them push the button!

Go find something else to do then, this doesn't really change anything.

Yes you broke rule #2. No you do not have a right to a trial. This is a privately owned server, we are in no way required to let you play here, we can at our own discretion ban any player we want. As we want a fair server, we give you a fair chance to present evidence that you should not be banned, and then receive a consensus decision based on that evidence. No vote. You've failed to give evidence disputing the allegations made against you, and as seen in this thread the consensus is overwhelmingly against you.Dionysus wrote:Day 5 of my captivity:

Re: Permajail for...what?
I see that your concept of consensus consists of an informal notion of how many people pass by the jail and jeer at the accused, but so be it.
Alright then, since I've been tried and apparently found guilty, and I will not be given any counsel, I submit the following mitigating factor and request a reduced sentence:
I will admit I used a texture pack that makes some blocks transparent. It is not called xray. It was called transparency pack. That is not a hack, it is a feature of minecraft enabled in the vanilla version which simply allows the use of alternate textures. As such it is vanilla, is not a hack. Using alternate texture packs is not prohibited by your stated rules.
Nor can it be said to confer an unfair advantage as the texture pack is available to all. Similarly, you all having playing on this server for months and months-- that confers upon you an unfair advantage against the likes of myself.
I followed your posted rules. I did not use an xray hack.
It was your opportunity and obligation to make sure your rules were clear and unambiguous. They are far from it. I maintain my innocence under Rule 2.
Nonetheless I understand you intend to uphold my ban. I therefore ask that you limit the duration to a 30 day period. I ask you release me from jail in 30 days. In the mean time I suggest you tighten up your stated rules to clarify that Rule 2 applies to texture packs that cause or allow blocks to be viewed as transparent.
Upon my release I will continue to follow the stated rules, as I always have.
What say you, benevolent ruler?

Re: Permajail for...what?
I have a morbid curiosity to let you go, just to see what kinda drama you could stir ingame.
Re: Permajail for...what?
wall hack is considered in the majority of game community's to be cheating. no matter if its texture och mod it is still wall hack. the rules are made by the server owner and he and he alone have the right to interpret it. u have no more rights on private property (the server) then he gives u. but u have given me a good read:P

Re: Permajail for...what?
The rule #2 reads as follows: no cheats/hacks/spam. This includes: Flymod, x-ray and manual spam (...). It does not say that, while you can't use xray hack, you can use xray texture pack. Seeing through walls is widely known in the MC community as x-ray - whether it's achieved by texture packs, hacks or any other means (there are other means). Also, when using that texture pack, you must have had the feeling that this falls under the "cheating" part of rule #2.Dionysus wrote:I followed your posted rules. I did not use an xray hack.

Just sayin. It's not so ambiguous as you make it to be.

I second this. Most interesting ban appeal so far. Uh, well, it's not like there are interesting ones anyway these days.Yukar9 wrote:I have a morbid curiosity to let you go, just to see what kinda drama you could stir ingame.
